arizona immigration lawThe United States Justice Department has decided to sue the state of Arizona on grounds that the new immigration law enacted by the state illegally intrudes on federal prerogatives. The feds are seeking an injunction to stop the law from coming into force.

The lawsuit is a result of Justice Department’s belief that enforcing immigration laws is federal responsibility and the fact that the Constitution states that federal law is above all state laws or acts.

The lawsuit also contains a civil rights component. The suitors argue that the new immigration law would lead to harassment of foreigners and U.S. national by the police. According to the President Barack Obama the new legislation could violate citizens’ civil rights.

The case has been filed in a court in Phoenix and is likely to escalate legal and political battle over the new immigration law. The law which was signed by Arizona Gov. Jan Brewer in April would come into force later this month, so an injunction would most likely be put up soon.

Most of the legal experts have said that the federal argument is most likely to persuade the judge to deem the new law unconstitutional.
